Terms of Service & Service Level Agreement

This Master Services Agreement governs the provision, operation, and acceptable use of all web hosting, NVMe cloud servers, domain registration, SSL certificates, software licenses, and managed sysadmin services provided by BillMeBD.

1. Acceptance of Terms & Account Eligibility

By registering an account, purchasing any product, or utilizing services provided by BillMeBD ("Company", "we", "our", or "us"), you ("Client", "Customer", or "User") agree to be legally bound by these Terms of Service, our Privacy Policy, and our Acceptable Use Policy (AUP).

You must be at least 18 years old and legally competent to enter into binding contracts. You agree to provide accurate, current, and verifiable contact and billing details during onboarding.

2. Account Verification, Anti-Fraud & KYC Compliance

To prevent fraudulent orders, stolen credit card usage, and malicious network activity, BillMeBD employs automated risk scoring and manual verification algorithms. We reserve the absolute right to request identity verification documents (Government-issued ID, Passport, or Business Registration) prior to provisioning high-value virtual machines, dedicated servers, or bulk domain portfolios.

Failure to complete mandatory identity checks when flagged may result in immediate order cancellation, payment reversal, or termination of pending accounts.

3. Acceptable Use Policy (AUP) & Zero-Tolerance Prohibitions

Our network and servers must be utilized solely for lawful purposes. The following activities are strictly prohibited across all shared hosting, cloud VPS, dedicated servers, and network subnets:

Unsolicited Bulk Email (SPAM) & Phishing Sending unsolicited commercial email, forging headers, hosting phishing landing pages, credential harvesters, or deceptive brand impersonations.
Network Attacks, Port Scanning & DDoS Initiating or amplifying Denial of Service attacks, IP spoofing, unauthorized port scanning, vulnerability probing, or running public open proxies.
Malware, Ransomware & Botnets Distributing trojans, rootkits, cryptominers, command-and-control (C2) servers, botnet controllers, or unlicensed copyrighted software cracks.
Illicit Material & Child Exploitation Hosting child sexual abuse material (CSAM), terrorism promotion, hate speech, or non-consensual media. Violations result in instant police/NCMEC reporting.

4. Domain Name Registration, Renewals & ICANN Compliance

Domain registrations are submitted in real-time to ICANN-accredited registrars and registry operators. By registering a domain:

  • Non-Refundable Registry Fees: Domain registrations, transfers, and renewals are immediately executed at upstream registries and are strictly non-refundable once registered.
  • WHOIS Accuracy: You agree to maintain accurate WHOIS contact details. Inaccurate WHOIS data may cause registry-level suspension under ICANN rules.
  • Renewal & Redemption Grace Periods: Domains must be renewed prior to their expiration date. Once expired, domains enter a 30-day renewal grace period followed by a registry redemption period (requiring high registry recovery surcharges) before being released to the general public.
  • WHOIS Privacy (ID Protection): Available on supported gTLDs to conceal personal contact details from public registries where permitted by registry policies (ccTLDs like .bd, .in, .us are excluded per registry mandates).

5. SSL / TLS Certificates & Cryptographic Warranties

All shared and cloud hosting packages include complimentary automated Let's Encrypt / AutoSSL certificates issued dynamically upon DNS propagation. Commercial SSL certificates (Organization Validation & Extended Validation) require external verification by independent Certificate Authorities (Sectigo, DigiCert). BillMeBD is not responsible for certificate rejection resulting from domain ownership disputes, sanction list matches, or incomplete organization documentation.

6. Cloud VPS & Bare-Metal Dedicated Servers

Virtual Private Servers (VPS) and Dedicated Server environments grant root/administrative access to the Client.

  • Root Access & Client Responsibility: The Client is solely responsible for OS configurations, software installations, firewalls, and security patching within their unmanaged instance.
  • Hardware & Network Quotas: Resource allocations (Dedicated vCPU, RAM, NVMe I/O, monthly bandwidth) are enforced via hypervisor governance. Sustained abusive resource saturation impacting neighbor nodes may trigger automated throttling.
  • IP Reputation & Nullrouting: If an assigned IP address receives incoming DDoS attacks exceeding our automated scrubbing capacity or sends outbound spam, BillMeBD reserves the right to temporarily nullroute the affected IP address to protect network integrity.

7. Software Licenses & Third-Party Addons

Software licenses provisioned through our portal (including cPanel/WHM, CloudLinux OS, LiteSpeed Web Server, Softaculous, Imunify360, and Microsoft Windows Server) are subject to upstream vendor licensing policies. License billing is recurring and non-refundable once activated. Modifications in upstream vendor wholesale pricing may be passed through upon 30 days written notice.

8. Technical Support Scope & Systems Administration SLA

Our technical support engineering team is available 24/7/365 via ticket desk and live chat.

Standard Managed Support Coverage: Included on All Shared Hosting & Managed VPS
  • Server hardware uptime, network routing, DNS infrastructure, and cPanel core health.
  • Automated daily/weekly backup restorations and account migrations from standard cPanel hosts.
  • Standard mail routing, SPF/DKIM/DMARC troubleshooting, and PHP version switches.
Out-of-Scope (Unmanaged): Third-party application code debugging, custom script programming, SEO optimization, or bespoke database query refactoring. Advanced custom sysadmin projects may be quoted separately on an hourly basis.

9. Billing Cycles, Automated Invoicing & Chargeback Penalties

All recurring subscriptions are billed in advance based on your selected frequency (Monthly, Quarterly, Annually, etc.):

  • Automated Renewal Invoices: Generated 7 to 14 days prior to service due dates. Invoices must be settled on or before the due date to avoid service disruption.
  • Suspension & Termination Grace Periods: Unpaid hosting services are automatically suspended 3 days past the due date. Unpaid accounts are terminated and permanently purged from server disks 14 days post-due.
  • Chargebacks & Payment Disputes: Initiating an unauthorized payment dispute, claim, or chargeback without contacting our billing desk will trigger immediate administrative suspension of all account services, domains, and a $25 USD / 2,500 BDT administrative dispute reversal fee.

10. 99.9% Infrastructure & Network Uptime SLA Guarantee

BillMeBD guarantees a minimum of 99.9% network and server hardware availability in any given calendar month. In the event of unscheduled verified outages exceeding this threshold, eligible clients may request service credit against future invoice cycles.

Exclusions: Scheduled maintenance announced in advance, upstream carrier fiber cuts beyond data center boundaries, Client software errors, or DDoS attacks exceeding scrub capacity.

11. Limitation of Liability & Governing Law

IN NO EVENT SHALL BILLMEBD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, BUSINESS INTERRUPTION, OR REVENUE) ARISING FROM SERVICE USE, SERVER HARDWARE FAILURE, OR NETWORK DOWNTIME.

Our total cumulative liability for any claim shall not exceed the aggregate amount paid by the Client to BillMeBD in the three (3) months preceding the event giving rise to the claim.
